Last updated: October 2026

Identification of the seller

NICHEBLOOM, a simplified joint-stock company with a share capital of 5,000.00 euros, registered with the Paris Trade and Companies Register under number 990 162 661, with its registered office at 49 rue de Ponthieu, 75008 Paris, France. Intra-Community VAT number: FR56990162661. Contact: info@nichebloom.com.

Article 1. Purpose and scope

These General Terms and Conditions of Sale (‘GTC’) govern the sale of NICHEBLOOM brand products (the ‘Products’) concluded on the nichebloom.com website (the ‘Website’) between NICHEBLOOM (the ‘Seller’) and any customer acting as a consumer for their personal needs (the ‘Customer’).

The Products are offered for sale to Customers located within the European Union. Any order placed on the Website implies the Customer’s unreserved acceptance of these GTC, which are accessible at any time on the Website. These GTC set out the full extent of the Parties’ obligations.

Businesses wishing to distribute the Products are subject to the B2B terms and conditions of sale, available on request.

Article 2. Amendments to the GTC

The Seller may amend these T&Cs at any time. Only the T&Cs published and in force on the date of the order shall apply. They are brought to the Customer’s attention upon confirmation of the order.

Article 3. Products

The essential characteristics of each Product (description, composition, capacity, instructions for use and precautions for use) are set out on its product page on the Website, in accordance with the provisions of Article L. 111-1 of the French Consumer Code. The photographs depict the Products as accurately as possible; minor variations in colour due to screen display do not constitute a breach of contract. Consequently, the Seller shall not be held liable in the event of a non-substantial difference between the photograph of the Products on the website and the Product ordered.

The range includes dual-purpose fragrances and scented products, designed for both pets and their owners, as well as dual-purpose accessories and furniture. The intended use of each Product, its instructions for use and precautions for use are set out on the product page, in the leaflet and on the packaging, all of which are available on the Website. Compliance with this intended use and these instructions is essential for the correct use of the Products; any non-compliant use is the sole responsibility of the Customer.

The Products offered for sale on the Website are available whilst stocks last.

Article 4. Prices

Prices are quoted in euros, inclusive of all taxes, at the VAT rate applicable in the country of delivery. They do not include delivery charges, which are shown to the Customer before the order is finally confirmed.

The Seller may amend its prices at any time; the Products are invoiced at the price in force at the time the order is confirmed.

Article 5. Order

Orders are placed on the Website by following these steps: selecting the Products, checking the basket, entering contact details and the delivery address, choosing the delivery method and payment method, then final confirmation, which constitutes a binding commitment to pay. Before final confirmation, the Customer may check the details of their order and the total price, and correct any errors.

The Customer undertakes to provide truthful information and thereby guarantees the accuracy of the details provided when confirming the order. Consequently, in the event of an error in the Customer’s contact details, the Seller shall not be liable for any failure to deliver the order.

The sale is concluded upon confirmation of the order by the Seller, sent to the Customer by email, summarising the order. As the Products are intended for personal use, unrelated to any professional activity, the Seller reserves the right not to confirm an order comprising more than five (5) Products of the same reference number, as well as in the event of a previous payment dispute or a legitimate suspicion of fraud.

Article 6. Payment

The price is payable in full, in cash, on the day the order is placed, using the payment methods offered on the Website at the time of payment. Transactions are secured by the Website’s payment service provider; credit card details do not pass through the Seller’s servers. The order is dispatched once payment has been confirmed.

Article 7. Delivery

The Products are delivered within the European Union, to the address specified by the Customer when placing the order. Two delivery options are available: standard delivery, which takes four (4) to five (5) working days, and express delivery, which takes forty-eight (48) hours. Delivery times are calculated from the date of dispatch confirmation; the applicable charges are specified before the order is confirmed.

Standard delivery charges are waived for any order totalling €150 or more, including VAT.

In any event, delivery shall take place no later than thirty (30) days after the order is placed, in accordance with Article L216-1 of the French Consumer Code. Failing this, the Customer may require the Seller to deliver within a reasonable additional period and then, if delivery has still not taken place, cancel the order; the Customer shall then be refunded within fourteen (14) days.

The risk of loss or damage to the Products passes to the Customer at the moment when the Customer, or a third party designated by them, takes physical possession of them. The Customer is advised to check the condition of the parcel on delivery and to report any issues to the carrier and to customer services within a maximum of 5 days from the date of delivery.

Article 8. Right of withdrawal

The Customer has a period of fourteen (14) days from receipt of the Products to exercise their right of withdrawal, without having to give any reason for their decision. They must notify the Seller of their decision before the expiry of this period, using the standard form set out at the end of these T&Cs or by means of any other unambiguous statement, sent to info@nichebloom.com.

The Customer must return the Products without undue delay and no later than fourteen (14) days after giving notice, to the following returns address:

NICHEBLOOM c/o FLAIRRR S.R.L.
Mariana Crisan
Strada III, No. 5, Arad Vest Industrial Estate
310491 ARAD
ROMANIA

Return shipping costs are borne by the Seller: once notified of the withdrawal, the Seller sends the Customer a prepaid return label.

The Products must be returned in their original, unopened packaging, complete and in a condition suitable for resale as new. The return must include all items from the order, including any gifts and samples provided.

In the event of a Product being damaged as a result of handling other than that necessary to establish its nature and characteristics, the Customer shall be liable in accordance with Article L. 221-23 of the Consumer Code. Returning a Product without its original packaging, or with packaging that is abnormally damaged, is considered to constitute a loss of value; opening a sealed Product renders it worthless, and its price will therefore not be refunded.

In accordance with Article L. 221-28(5) of the Consumer Code, the right of withdrawal cannot be exercised for perfumes and other sealed products which cannot be returned for reasons of hygiene or health protection once they have been opened, unsealed or used after delivery: a perfume whose box has been opened, whose adhesive strips or protective film have been broken, or which has been used, cannot therefore be returned or refunded on these grounds. The same applies to products personalised at the Customer’s request (Article L221-28(3)).

Accessories and furniture may be returned in accordance with the terms of this article; they must be returned unused, unassembled, complete and in their original packaging.

The Seller shall refund the Customer the full amount paid, including the initial delivery charges (at the standard rate), to the bank account specified on the order, no later than fourteen (14) days from the date on which the Seller is notified of the withdrawal; the refund may be deferred until the Products have been received or until the Customer has provided proof of their dispatch. The refund will be made using the same payment method as that used for the order, unless the Customer expressly agrees to another method.

Article 9. Statutory Warranties

All Products are covered by the statutory guarantee of conformity (Articles L. 217-3 et seq. of the Consumer Code) and the guarantee against hidden defects (Articles 1641 et seq. of the Civil Code). To make a claim, the Customer should contact customer services: info@nichebloom.com.

Regulatory reminder

The consumer has a period of two (2) years from the date of delivery of the goods to claim under the statutory guarantee of conformity should a lack of conformity arise. During this period, the consumer is only required to establish the existence of the lack of conformity and not the date on which it first appeared.

The statutory guarantee of conformity entitles the consumer to have the goods repaired or replaced within thirty days of their request, at no cost and without significant inconvenience to them. If the goods are not repaired or replaced, the consumer may obtain a price reduction or the termination of the contract.

The consumer is also covered by the statutory guarantee against hidden defects pursuant to Articles 1641 to 1649 of the Civil Code, for a period of two years from the discovery of the defect. This guarantee entitles the consumer to a price reduction if the goods are retained, or to a full refund upon return of the goods.

These guarantees apply irrespective of any commercial commitments made by the Seller.

Article 10. Liability

The Seller is automatically liable for the proper fulfilment of the order, in accordance with Article L. 221-15 of the Consumer Code. However, the Seller shall not be held liable in the event of non-performance or improper performance attributable to the Customer, to an unforeseeable and insurmountable act by a third party unrelated to the order, or to a case of force majeure as defined in Article 1218 of the Civil Code.

The use of the Products in breach of the instructions for use and safety precautions set out on the packaging, in the leaflet and on the product information sheet is the sole responsibility of the Customer.

Article 11. Intellectual Property

The ‘NICHEBLOOM’ trademark, the Website and all its elements (text, visuals, photographs, logos) are protected by intellectual property rights held or licensed by the Seller. Any reproduction or use other than browsing the Website and the personal use of the Products is prohibited without prior written authorisation.

Article 12. Personal Data

The Customer’s personal data is collected and processed by the Seller for the purposes of managing orders, deliveries, payments and customer service and, with the Customer’s consent, for marketing communications, in accordance with Regulation (EU) 2016/679 (GDPR) and the French Data Protection Act. The Customer has the rights of access, rectification, erasure, objection, restriction and data portability, which may be exercised by contacting info@nichebloom.com. Details of the processing operations are set out in the Privacy Policy available on the Website.

Article 13. Consumer Mediation

In the event of a dispute or disagreement, the Customer is invited to contact the customer service department of NICHEBLOOM in the first instance in order to attempt to reach an amicable solution.

In accordance with the provisions of the Consumer Code concerning the mediation process for consumer disputes, the Customer, as a consumer, has the right to make use of the mediation service offered by our company free of charge.

The designated consumer mediator is the Centre for Consumer Mediation by Judicial Conciliators (CM2C).

If the consumer’s initial written approach to our company has been unsuccessful, the Mediator may be referred to in respect of any consumer dispute that has not been resolved.

To refer a dispute to the mediator, the Customer may:

  • Complete the online form on the CM2C website: Report a dispute on CM2C
  • Send a letter by post to the following address: CM2C, 49 Rue de Ponthieu, 75008 Paris.

Article 14. Governing law

These General Terms and Conditions are governed by French law. Consumer Customers residing in another Member State of the European Union shall retain the benefit of any mandatory provisions in the law of their country of habitual residence that offer greater protection. Any dispute that cannot be resolved amicably shall be subject to the jurisdiction of the competent courts in accordance with the provisions of ordinary law.

If any provision of these Terms and Conditions of Sale should be found to be invalid under any applicable law or regulation and/or a court ruling having the force of res judicata, it shall be deemed to have never been written, but shall in no way affect the validity of the other clauses, which shall remain applicable.
